We may disclose information to law enforcement bodies, regulatory authorities, government agencies, courts or other third parties where we believe disclosure is necessary to comply with a legal obligation, court order or regulatory requirement; establish, exercise or defend legal rights; investigate or prevent unlawful activity; protect our systems, customers or users; or protect the rights, property, safety or interests of Reshift Media or others.
Business transactions. We may disclose personal information to a potential or actual purchaser, investor, successor, lender, adviser or other party in connection with a proposed or completed financing, investment, reorganization, merger, acquisition, sale or transfer of all or part of our business or assets.
With your consent or direction. We may disclose information to another person or organization where you have consented to or directed the disclosure.
We do not sell personal information to third parties.
Where European or United Kingdom data protection laws apply, our legal basis for collecting and using personal information will depend on the information concerned and the circumstances in which we collect or process it.
We will normally process personal information where we have your consent, where processing is necessary to perform a contract with you or take steps at your request before entering into a contract, where processing is necessary for compliance with a legal obligation, or where processing is in our legitimate interests or those of a third party and those interests are not overridden by your data protection interests or fundamental rights and freedoms.
Where we ask you to provide personal information to comply with a legal requirement or perform a contract with you, we will identify this where appropriate and advise whether providing the information is mandatory and of the possible consequences of not providing it.
Where we rely on legitimate interests, those interests may include operating, securing, supporting, developing and improving our business, Site and Service; communicating with customers and users; preventing fraud and misuse; and protecting our rights and systems.

We use cookies and similar tracking technologies (collectively, “Cookies”) to collect and use information about visitors and users, including for analytics, functionality, security, personalization and, where applicable, advertising.
For more information about the Cookies we use, why we use them and how you can control them, please see our Cookie Policy.
Franify and/or Brand Amplifier may use SMS text messaging to support two-factor authentication (“2FA”), account security and other Service-related functionality made available to users.
Where you enable SMS-based authentication and provide your mobile telephone number, you consent to receive one-time verification codes and other security-related messages necessary to verify your identity and protect your account.
Message frequency varies based on account activity and login attempts. Message and data rates may apply according to your mobile carrier’s plan.
Where available, you may disable SMS-based two-factor authentication through your account settings. You may also follow the instructions contained in an applicable SMS message to stop receiving messages. Disabling security-related SMS messages may prevent you from using SMS-based authentication.
We do not share mobile telephone numbers, SMS consent records or related opt-in information with third parties or affiliates for their own independent marketing or promotional purposes.
We may share mobile telephone numbers and related information with service providers that assist us in providing SMS, authentication, security and related functionality.
All SMS communications and related data handling practices are subject to this Privacy Policy.
Depending on where you reside and the laws applicable to you, you may have rights relating to your personal information, including rights to request access to or correction of personal information, withdraw consent where processing is based on consent, request deletion in certain circumstances, object to or restrict certain processing, request portability where applicable, or make a complaint to an appropriate privacy or data protection authority.
You may submit a privacy request by contacting us using the information under the “How to Contact Us” section below.
If you request deletion of information necessary to provide the Service, we may be unable to continue providing some or all of the Service to you.
You may opt out of marketing communications we send by using the unsubscribe or opt-out mechanism included in those communications or by contacting us. Even if you opt out of marketing communications, we may continue to send transactional, administrative, account, security and other Service-related communications.
If we have collected and processed personal information with your consent, you may withdraw that consent, subject to legal or contractual restrictions and reasonable notice. Withdrawal will not affect processing that occurred before the withdrawal.
We respond to privacy requests in accordance with the privacy and data protection laws applicable to the request.
Information We Process on Behalf of Customers. In certain circumstances, Reshift Media processes personal information on behalf of customers using Brand Amplifier, Franify or another Reshift Media Service. This may include personal information relating to a customer’s employees, franchisees, customers, prospective customers, prospective franchisees, leads, social media users and other individuals.
In these circumstances, the applicable customer may determine the purposes for which personal information is collected and processed, and Reshift Media processes that information in connection with providing the Service and in accordance with our agreements with the customer.
If your personal information has been submitted to or processed through our Service on behalf of one of our customers, you may need to direct a privacy request to that customer. Where appropriate, we may refer or forward your request to the applicable customer for handling.
We use administrative, technical and organizational safeguards designed to protect personal information against unauthorized access, use, disclosure, alteration or destruction.
These measures may include network and host security controls, access controls, firewalls, monitoring, encryption at rest and during transmission where appropriate, authentication mechanisms, operating procedures and other security measures.
No method of electronic transmission, processing or storage is completely secure, and we cannot guarantee absolute security.
You are responsible for maintaining the confidentiality of your account credentials and should not share your user ID, password or authentication credentials with unauthorized persons.
Where available, we recommend enabling two-step or multi-factor authentication.
If you believe your account credentials have been compromised or you have difficulty securing your account, please contact our technical support team.
We retain personal information for as long as reasonably necessary to fulfill the purposes for which it was collected or processed, provide the Service, satisfy legitimate business requirements, resolve disputes, enforce agreements and satisfy legal, tax, accounting, security or other requirements.
The appropriate retention period may vary depending on the nature of the information, why it was collected, how it is used, customer requirements and applicable legal or contractual obligations.
Where we process personal information on behalf of a customer, retention may also be determined by our agreement with and instructions from that customer.
When personal information is no longer required, we may delete, destroy, anonymize or de-identify it. Where immediate deletion is not reasonably possible, such as information contained in backup or archival systems, the information may remain stored until deletion or overwriting occurs in the ordinary course.
We may send promotional, informational or marketing communications in accordance with applicable requirements.
You may opt out of marketing emails by following the unsubscribe or opt-out instructions contained in the applicable communication or by contacting us.
We will process opt-out requests within the time required by applicable requirements.
If you opt out of marketing communications, we may still send communications relating to your account, transactions, security, support, administration or Services you have requested or received.

The privacy and data protection laws of those jurisdictions may differ from those in your jurisdiction. Information processed in another jurisdiction may also be accessible to courts, law enforcement, regulatory authorities or government agencies in that jurisdiction in accordance with its laws.
